We identified that rather than being anxious about court outcomes, can we list down 10 most critical questions we need to answer to solve our case,
- Do we understand the accusations against us better ?
- What is the evidence produced against us in the police stations ?
- What are FIR details ?
- Do we know the specifics of IPC sections in our case ?
- Are there related cases and judgements ? Can we cite those in police stations ?
- What evidence needs to be produced before the police to prove innocence ?
- Are there any provisions in court of law to quash the case and police investigations from higher judiciary ?
- Are there options to register counter cases for pain of justice ?
- Can we shortlist the right advocate to fight for our case ? Can we assist our advocate in drafting and legal research activities ?
- Shall we fight the case or opt for an out of court settlement ?
Once we were able to better define our problem in terms of questions , it gave us a structure, a path forward to take up next steps. We Started with Question 1 and astonishingly took step by step for each question. Later we determined answers for each question by talking to experts in the field - be it advocates, accused like us, media or google search.
But one secret which helped maximum was previous case references. We went across the digital version and that time more relied on hard copies. Read entire case histories , understand what kind of evidence gave strength to our case, which case was relevant and where it was applicable. It certainly helped out advocates to cite cases better. We shall provide all these methods of legal research in later chapters.
